Welcome to Devira, operated by Ty S B LLC, a California limited liability company (“Devira,” “we,” “us,” or “our”). Our online store is hosted on Shopify.
These Terms of Service (“Terms”) govern your use of our website and services and your purchase of Devira food products. Please review these Terms, our Shipping & Delivery Policy, and our Returns & Refund Policy before ordering. Our Privacy Policy separately explains how we handle personal information.
By expressly accepting these Terms during checkout or through another acceptance process, you agree to be bound by them. Nothing in these Terms limits consumer rights that cannot lawfully be waived.
1. About Devira
Devira is a premium specialty food brand offering spices, spice blends, and related food products to customers across the United States through our Shopify-powered online store. Devira is operated by Ty S B LLC, a California limited liability company.
2. Acceptable Use of the Devira Website
You may use Devira’s Shopify-powered website only for lawful purposes. You must not damage, disable, overburden, or interfere with the website or its supporting systems, attempt unauthorized access, introduce malicious software, or disrupt other visitors’ use of the website.
3. Product Information, Availability & Purchase Limits
We make reasonable efforts to keep product descriptions, pricing, and availability accurate on Devira’s Shopify-powered online store. Product colors and packaging may appear different depending on your screen settings, and packaging designs may change. Review the label on the product you receive for ingredients, allergen information, and storage instructions.
We may update product information, discontinue products, or limit purchase quantities, subject to applicable law. If an error or availability issue affects an existing order, we will notify you and provide any cancellation or refund options required by law. Nothing in this section limits your rights regarding products that are defective, unsafe, or materially different from their description.
4. Order Acceptance, Cancellations & Refunds
Placing an order through Devira’s Shopify-powered store constitutes an offer to purchase. An automated order confirmation acknowledges receipt of your order and does not, by itself, constitute acceptance.
Subject to applicable law, Devira may decline or cancel an order because of product unavailability, a pricing or product information error, suspected fraud, or an unauthorized transaction. We will notify you if we decline or cancel your order.
If payment has already been collected, we will promptly refund all amounts paid for the canceled items, including applicable taxes and shipping charges attributable to those items, to your original payment method. We will not charge a higher price or substitute products without your agreement.
Nothing in this section limits your cancellation, refund, or other rights under applicable consumer protection laws.
5. Pricing, Taxes & Payments
Product prices on Devira’s Shopify-powered store may change for future purchases. Price changes do not alter orders we have already accepted.
Displayed prices include mandatory charges required by applicable law. Applicable taxes and shipping costs are calculated and clearly shown at checkout before you submit your order.
Payments are processed through Shopify’s checkout using the payment providers and methods available at checkout. By submitting payment information, you confirm that you are authorized to use the selected payment method and authorize payment of the displayed order total.
6. Shipping, Delivery & Address Accuracy
Devira ships orders using the shipping option selected at checkout through our Shopify-powered store. Available methods, charges, and estimated delivery times are displayed before you place your order.
Delivery dates are estimates unless expressly guaranteed. Carrier delays may affect arrival times. If we cannot ship within the stated timeframe—or within 30 days when no shipment timeframe is stated—we will notify you and offer the choice to accept a delay or cancel for a prompt refund, as required by law.
Please provide a complete, accurate shipping address and review it before submitting your order. If you notice an error, contact care@devirafoods.com promptly. Address changes may not be possible after processing or shipment.

7. Food Product Returns & Refunds
Returns and refunds for purchases through Devira’s Shopify-powered store are governed by our Returns & Refund Policy. Certain food products may be ineligible for physical return for food safety reasons, as disclosed before purchase.
A restriction on physical returns does not eliminate any refund, replacement, or other remedy required by applicable law for damaged, defective, unsafe, or incorrectly supplied products. For assistance, contact care@devirafoods.com.
8. Subscriptions, Recurring Orders & Cancellation
If you enroll in a Devira subscription through our Shopify-powered store, orders and payments recur automatically on the schedule you select until you cancel.
Before enrollment, we clearly disclose the recurring price, billing frequency, applicable taxes and shipping charges, cancellation terms, and any minimum commitment. We obtain your express affirmative consent to recurring charges and provide a confirmation containing the subscription terms and cancellation instructions.
You can manage or cancel your subscription online through your customer account. Cancellation stops future renewals; orders already charged or shipped are handled under our Returns & Refund Policy, subject to applicable law. For assistance, contact care@devirafoods.com.
We provide renewal reminders and notices of price or other material changes when required by applicable law.
9. Customer Accounts & Account Security
When creating or using an account on Devira’s Shopify-powered store, provide accurate information and keep your contact, billing, and shipping details current.
Keep your sign-in credentials and verification codes confidential. You are responsible for the activity you authorize through your account. If you suspect unauthorized access, contact care@devirafoods.com promptly.
Nothing in this section limits Devira’s privacy and security obligations or your rights regarding unauthorized transactions under applicable law.
10. Website Content & Intellectual Property
Content on the Devira website—including text, product images, graphics, logos, and designs—is owned by or licensed to Devira and protected by applicable intellectual property laws.
Except as permitted by law, you may not reproduce, distribute, modify, or commercially use this content without prior written permission from Devira or the applicable rights holder.
11. User Content and Reviews
If you submit reviews, photographs, comments, testimonials, or other content to Devira, you represent that you have the right to submit that content.
By submitting content, you grant Devira a non-exclusive, royalty-free right to use, reproduce, display, and publish the content in connection with our business and marketing, subject to applicable law.
12. Customer Reviews & Submitted Content
When you submit reviews, photos, recipes, or other content for publication through Devira’s Shopify-powered store, you confirm that you own the content or have the permissions needed to submit it.
You retain ownership of your content and grant Devira a non-exclusive, royalty-free license to reproduce, display, and publish it in connection with our products and services. We may use Shopify and connected providers to host and display that content. Any formatting or editing will preserve its meaning and accurately represent your experience.
This permission does not apply to private customer support communications. Nothing in these Terms restricts your right to share honest reviews or imposes a penalty for negative feedback.
13. Shopify & Third-Party Services
Devira’s online store is hosted on Shopify and uses third-party providers for payment processing, shipping, analytics, and marketing. When you interact directly with an external service, its separate terms and privacy policy may also apply.
These providers control their own services and independent practices. Our use of Shopify and other providers does not limit Devira’s responsibilities for your order, our obligations regarding personal information, or your rights under applicable law.
14. Website Availability & Food Information
The Devira website provides product information, recipes, and online shopping for spices, spice blends, and related food products. We aim to keep the website available but cannot guarantee uninterrupted or error-free access.
Website content is for general informational purposes and does not replace professional medical or individualized dietary advice. Consult a qualified healthcare professional about allergies, medical conditions, or specific dietary needs.
15. Limitation of Liability
To the extent permitted by applicable law, Devira is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our website or purchase of our products.
This limitation does not apply to fraud, willful misconduct, or any liability that cannot lawfully be excluded or limited. Nothing in these Terms limits your non-waivable consumer rights or remedies.
16. Indemnification
To the extent permitted by applicable law, you agree to indemnify Ty S B LLC, doing business as Devira, for third-party claims and reasonable costs arising from your unlawful misuse of our website or material violation of these Terms.
This obligation does not apply to claims caused by Devira’s negligence, misconduct, or violation of law, and does not limit your non-waivable consumer rights.
17. Changes to These Terms of Service
Devira may update these Terms of Service and will revise the “Last updated” date when changes are made. For material changes, we will provide appropriate notice and obtain your agreement where required by law.
Updates apply prospectively and do not change the terms of previously accepted orders unless you agree or applicable law permits.
18. Governing Law & Consumer Rights
These Terms of Service and purchases from Devira’s Shopify-powered online store are governed by California law, subject to applicable federal law. This choice of law does not deprive you of mandatory consumer protections available under the laws of your state of residence.
